Indigo Sues Mahindra Over '6E' Mark Use in New EV, Automaker Seeks "Amicable Solution"

After Indigo sued Mahindra Electric Automobile (MEAL) for trademark infringement for the use of the mark '6E' in its new electric car called Mahindra BE 6E, the automaker denied any conflict stating, "MEAL has applied for trade mark registration under class 12 (vehicles) for “BE 6e” a part of its electric origin SUV portfolio. Hence, the Company does not see a conflict as Mahindra’s mark is “BE 6e”, not the standalone “6E”."

India's largest airline Indigo had approached the intellectual property division of Delhi High Court for relief in the case titled Interglobe Aviation Vs Mahindra Electric Automobile Ltd, according to a report by Bar and Bench.

After Justice Amit Bansal recused from hearing the case, it is now expected to be heard on December 9.

In a filing to the exchanges, Mahindra stated that its mark is fundamentally different from that of Indigo which represents an airline, "eliminating any risk of confusion". "The distinct styling further emphasizes their uniqueness," it added.

It also mentioned that it is in discussion with InterGlobe Aviation to find an "amicable solution". The company emphasised that the company has complied with and continues to comply with the relevant disclosure norms under the Listing Regulations.

Indigo's Trademark

Indigo operates under the callsign "6E" which is its official designator and a key element of its branding.

The 6E brand has a range of passenger centric services for enhancing the travel experience. The services include 6E Prime which offers benefits like seat selection, priority check-in and complimentary snacks. 6E Flex is another service allowing for unlimited rescheduling and cancellation flexibility. Moreover, the 6E add-ons include customisable options such as extra baggage, pre-booked meals and lounge access.

Indigo had obtained the word mark 6E Link in 2015. It has permission to use 6E for electronic advertising display and illuminated advertising signs. It can also use it for banner advertising, online advertising, television advertising and ad services related to transport and delivery services.

Mahindra BE 6e

Mahindra Electric's request to register the word mark of BE 6E was accepted by the registrar of trademarks on November 25. If registered, it will be permitted to use the word mark for a wide range of motor vehicles and related components, including land vehicles, off-road and utility vehicles, electric and internal combustion engine-powered vehicles, buses, trucks, tractors and parts, excluding two-wheelers.

Mahindra's recently-launched electric model has been praised for its unique design and features. Although the car is unveiled, it is yet to open for booking, and deliveries will only start next year.
